General Terms and Conditions of Linkido

1. General provisions
1.1. The Platform is the website linkido.com.
1.2. The Client is a natural or legal person who has created a user account of the Platform.
1.3. The Teacher/Specialist is a certified teacher, experienced specialist, or an expert in their subject area, who has at least a bachelor’s degree and who conducts the courses offered on the Platform.
1.4. The Contract is concluded between the Client and the Teacher/Specialist.
1.5. Linkido OÜ (register code 14505711, address Harju County, Harku Parish, Suurupi Village, Sombre Road 2, 76907, Estonia) is the company registered in the Republic of Estonia who owns the Platform.
1.6. The General Terms and Conditions establish the terms of use of the Platform by the Client and the rights and obligations of the parties.

2. General principles of tutoring sessions organized by linkido.com
2.1. Linkido.com is an online tutoring platform that connects students with qualified teachers/specialists for personalized one-on-one tutoring sessions, as well as offering group courses for collaborative learning experiences.
2.2. Linkido.com does not train the Clients themselves.
2.3. Linkido.com offers tutoring services in a wide range of subjects, including school courses, university courses, IT courses, language courses, behavioral and psychological guidance, and graphic design.
2.4. All the information about specific courses and tutoring sessions shall be published on the Platform at the introduction of the specific course.
2.5. All the information about a specific teacher/specialist shall be published on the Platform at the introduction of the specific teacher/specialist.
2.6. Unless otherwise stated in the introduction of the courses, the following rules shall apply:
2.6.1. Online tutoring on linkido.com is conducted through a virtual classroom, where the Client and the Teacher/Specialist can interact in real-time using video and audio.
2.6.2. The virtual classroom is suitable for use with any browser and operating system, and it is not necessary to download additional software.
2.6.3. All the study materials in the courses are exclusively provided by the teachers/specialists. The Linkido platform does not provide or upload any materials on its own, and Linkido assumes no liability for any materials uploaded by the teachers/specialists.
2.6.4. The Client can choose a Teacher/Specialist from the selection on the Platform and book an appointment.
2.6.5. After choosing a Teacher/Specialist, the Client can contact the teacher/specialist and describe learning objectives and ask questions.
2.6.6. The Teacher/Specialist will offer a customized solution to meet the Client’s needs or ask any additional questions as needed.
2.6.7. The teachers/specialists typically respond within 24 hours, but response times may vary depending on their availability.
2.6.8. Linkido.com cannot guarantee that the Teacher/Specialist shall answer all the questions but, if possible, the Teacher/Specialist shall try to proceed from the questions sent in advance when preparing the training.
2.6.9. The tutoring session will take place at the agreed study time in the virtual classroom.

3. Purchase and payment
3.1. The Client must create an account on linkido.com.
3.2. The Client must confirm that he or she is at least 18 years old. The underage Client must confirm that he or she has the consent of a legal representative.
3.3. The Client will choose a course and a Teacher/Specialist and will contact the Teacher/Specialist.
3.4. Once the Client has discussed the learning requirements with the Teacher/Specialist and agreed on the specific details of the course, the Teacher/Specialist will send a personalized link which includes the amount of hours, agreed study time, price, and payment instructions.
3.5. The teachers/specialists determine the price of the course for each Client individually, based on the specific course, client’s wishes, and agreed study time.
3.6. The price of the course is calculated in euros.
3.7. Payment service is provided by the Stripe payment gateway, which is integrated into the website.

4. Right of withdrawal
4.1. The Client may withdraw from a contract within 14 days without giving any reason.
4.2. The period shall commence as of the day of entry into the contract. The contract is considered concluded if the Client and the Teacher/Specialist have agreed on circumstances specified in clause 3.4, and the Client has made the payment.
4.3. The Client can withdraw from the contract by filling out the withdrawal form available at https://linkido.com/claims or by sending a notice of withdrawal to the Platform’s e-mail address info@linkido.com.
4.4. Upon receipt of an application for withdrawal, linkido.com shall return to the Client immediately but at not later than after 14 days all the payments received from the Client based on the contract.
4.5. If the Client wanted the courses to start during the withdrawal period specified in clause 4.1, the Client must pay an amount that is proportional to the completed courses until the time when the client announced his or her wish to withdraw from the contract, compared to the total amount of the contract.
4.6. In the case described in clause 4.5, linkido.com shall return to the Client immediately but at not later than after 14 days payments in proportion to the courses completed by the Client.
4.7. The Client cannot use the right of withdrawal specified in clause 4.1 if he or she has completed the courses in full.

5. The Client’s Rights and obligations
5.1. The Client undertakes to use the linkido.com platform in accordance with the law, good practices, and rules of linkido.com.
5.2. The Client does not have the right to transfer participation in the courses to third parties.
5.3. The Client can change the teacher/specialist within the 7 days from the start of the courses if the Client is not satisfied with the teacher/specialist.
5.4. The Client has the right to participate in the tutoring sessions at the agreed time.
5.5. If the Teacher/Specialist is unable to conduct the tutoring session at the agreed time, the Teacher/Specialist will contact the Client immediately and offer a new time or a refund.
5.6. If the Client is unable to participate in the tutoring session at the agreed time, the Client will contact the Teacher/Specialist immediately, but not later than 1 day before the tutoring session. The Teacher/Specialist will offer a new time if the Client has notified the Teacher/Specialist in a timely manner. If the Client has notified the Teacher/Specialist later than 1 day before the tutoring session, the Teacher/Specialist does not have to offer a new time, and the payment is not refunded.
5.7. If the Client experiences technical difficulties during a tutoring session, the Platform’s support or assistance will help the Client.

6. The Teacher/Specialist’s rights and obligations
6.1. The Teacher/Specialist undertakes to use the linkido.com platform in accordance with the law, good practices, and rules of linkido.com.
6.2. The Teacher/Specialist does not have the right to transfer conducting the courses to third parties.
6.3. The Teacher/Specialist must guarantee that he or she has at least a bachelor’s degree and other qualifications which are necessary for conducting the courses.
6.3.1. The teachers conducting school and university courses must have pedagogical education.
6.3.2. The specialists providing psychological consulting must have a professional certificate.
6.4. The Teacher/Specialist will answer to the Client’s requests typically in 24 hours but not later than 3 days.
6.5. The Teacher/Specialist will prepare an individual program for each Client based on the Client’s wishes.
6.6. The Teacher/Specialist will send a personalized link to the Client, which includes the number of hours, agreed study time, price, and payment instructions.
6.7. The Teacher/Specialist pays taxes on the fee received.
6.8. The Teacher/Specialist receives a specific commission fee from the platform for every course they create.
6.9. The Teacher/Specialist will conduct the tutoring session at the agreed time.
6.10. If the Teacher/Specialist is unable to conduct the tutoring session at the agreed time, the Teacher/Specialist will contact the Client immediately and offer a new time or a refund.

7. The Platform’s rights and obligations
7.1. The Platform connects students with qualified teachers/specialists for personalized one-on-one tutoring sessions, as well as offering group courses for collaborative learning experiences.
7.2. The Platform deals with advertising and finding teachers/specialists and clients.
7.3. The Platform offers help with technical difficulties.
7.4. The Platform has the right to ask a commission fee from teachers/specialists.
7.5. The Platform has the right to check teachers/specialists’ compliance with qualifications and with other rules of the platform.
7.6. In the case of repeated violation of the rules of the Platform, the Platform has the right to suspend the access to the Platform.

8. Liability
8.1. The service provider is liable to the Client only for non-performance of an obligation, which is caused intentionally or due to gross negligence.
8.2. The Platform is not liable for the quality of education.

9. Solving disputes
9.1. If the Client has any claims, the Client must address them by the form available on the Platform at https://linkido.com/claims.
9.2. Disputes between the Parties shall be resolved by negotiations between the Parties.
9.3. In the case of non-performance with the terms of the contract, the Client can rely on legal remedies provided by law: 1) require performance of the obligation; 2) withhold performance of an obligation that is due from the obligee; 3) demand compensation for damage; 4) withdraw from or cancel the contract; 5) reduce the price; 6) in the case of a delay in the performance of a monetary obligation, demand payment of a penalty for late payment.
9.4. If disputes cannot be resolved through negotiations, the Client can turn to the Consumer Disputes Commission. The procedural conditions can be found here.

10. Final provisions
10.1. The law of the Republic of Estonia shall apply to the General Terms and Conditions, and the law of the Republic of Estonia shall be the final applicable law.
10.2. The disputes shall be resolved in courts of the Republic of Estonia.
10.3. The invalidity or nullity of an individual provision of the General Terms and Conditions shall not result in the invalidity of all or any other provisions of the General Terms and Conditions.
10.4. Linkido OÜ has the right to change the General Terms and Conditions unilaterally. Linkido OÜ shall publish the revised version of the General Terms and Conditions on the website (https://linkido.com).
